MAUI COUNTY'S STRONG CREDIT RATING REAFFIRMED BY THREE BOND
AGENCIES – September 2018
Mayor Alan Arakawa today announced that three major bond rating agencies
awarded Maui County the highest bond ratings in the state last week.
Moody's, Standard & Poor's and Fitch rated Maui County Aa1/AA+/AA+ on the
Series 2018 bonds.
These ratings refect the County of Maui's strong fnancial position and sound
management. Fitch Ratings reports that Maui County's “fnancial resilience is
very strong” and “budget management during the economic expansion has
been solid, with the County setting aside reserves to address long-term
liabilities and emergencies.”
2. “These bond ratings solidify what we have come to expect in Maui County –
sound fnancial management and a strong economic outlook,” said Arakawa.
“High bond ratings are important because they are the county's equivalent of
someone's personal credit score or credit rating, said Finance Director Mark
Walker.
“It means spending less taxpayer money on borrowing money for important
projects, because we're paying less interest over time,” said Managing Director
Keith Regan.
“The fact that Maui County received such a great score means millions of
dollars saved for taxpayers. I commend Finance Director Mark Walker, Deputy
Director Jack Kulp, Budget Director Sandy Baz, Treasurer May-Anne Alibin and
their people for all their fne work,” added Arakawa.
The news about high bond ratings comes on the heels of two other budget and
fnance awards for Maui County this year. The Government Finance Ofcers
Association (GFOA) of the United States and Canada awarded the county the
Distinguished Budget Presentation Award as well as the Certifcate of
Achievement for Excellence in Financial Reporting.
The Certifcate of Achievement is the highest form of recognition in the area of
government accounting and fnancial reporting, while the Distinguished Budget
award refects the commitment of a governing body and staf to meeting the
highest principals of governmental budgeting.

On this year's general election ballot, the following question will be posed to
voters: “Shall the legislature be authorized to establish, as provided by law, a
surcharge on investment real property to be used to support public education?”
Residents have had a number of questions relating to this measure and the
related item in the Budget and Finance Committee, which I chair, so I ofer the
following information relating to the most commonly asked questions:
I own a single-family home. If this amendment is approved, will my
property taxes increase?
SB 2922, which authorized the proposed Constitutional Amendment, uses the
terms “investment real property” and “surcharge.” Earlier versions of the bill
defned “investment real property” as properties which did not qualify for a
homeowner exemption, valued at $1 million or more. However, this language
was removed from the bill, leaving the term and the surcharge amount
undefned.
Merriam-Webster's dictionary defnes “surcharge” as an additional tax, cost, or
impost. The Legislature will now have full discretion in determining what
qualifes as investment real property and the rate of the additional tax.
Arguably, any real property is an investment.
With that said, even if the additional tax is not applied to primary residences
owned by local families, real property tax rates may still be impacted. Maui
County garners 77 percent of its general fund revenue from taxes on real
property. If the state taps into our primary revenue source, the county may be
forced to consider raising rates from other sources.
Will county services like fre protection and senior services be impacted by
the surcharge?
4. Property taxes fund an array of county services such as fre protection, police,
pools, parks, senior services, economic development, social welfare programs,
and emergency management during natural disasters.
If the state increases property taxes, county services may be adversely afected,
and county-funding priorities may need to be reevaluated. The county's bond
rating may also be impacted, which could impede borrowing for infrastructure
projects.
Currently, the county funds educational initiatives, including after-school
activities and transportation for extracurricular programs; vocational training
and opportunities; and in-school clubs and activities, just to name a few.
The county also provides a wide range of facilities countywide for educational
and athletic events such as Wells Park, War Memorial Gym complex, and
Kokua Pool. The availability to fund these initiatives and the upkeep of our
facilities may also be adversely afected by the surcharge.
Will the amendment guarantee higher teacher salaries and better programs
for our keiki?
Proponents of the measure promise monies will be used to support our
teachers, increase public access to preschool, lower class sizes, improve special
education, expand vocational and arts courses, and provide Hawaiian cultural
instruction. We all support these opportunities for our keiki. However, the
language of the bill does not require funds to be used for these purposes. The
vagueness of the measure raises red fags.
Teacher salaries are determined through a collective bargaining process.
Simply passing this amendment would not guarantee higher teacher salaries or
benefts.
5. The bill also does not require a net increase in funding for the DOE, but rather,
just afords the Legislature the power to collect local property taxes. With a
current budget of $1.99 billion, the DOE should also evaluate internal efciency
to ensure our teachers are appropriately compensated, classrooms are air-
conditioned, and students are receiving high-quality educational opportunities.

PASSING BALLOT MEASURE MAY HAVE ADVERSE IMPLICATIONS

During this year's general election on Nov. 6, there is a ballot measure which
reads, “Shall the legislature be authorized to establish, as provided by law, a
surcharge on investment real property to be used to support public education?”
Please note that as written, the passing of this ballot measure may have adverse
implications for the County of Maui. As your mayor I feel I have an obligation
to point out these negative impacts in order to provide you with the
information you need to make your own educated decision as voters.
Before I get into that however, I'd like to point out that Maui County has always
and will always support education on every possible level. We may not be
paying teachers' salaries but we help the state Department of Education (DOE)
out in other ways, by putting playground equipment in parks next to schools,
by funding grants for use by U.H. Maui College and by helping to provide safer
routes to school, by improving roads, sidewalks and even installing
roundabouts.
Every dollar we spend improving infrastructure surrounding our schools is a
dollar the DOE doesn't have to spend.
6. In any case, you should know that frst, there is no guarantee that allowing the
state to tap into your county property taxes will mean an increase in the DOE
budget. Rather, your property taxes will go directly into the state general fund
and from there the money can go anywhere. Secondly, look up the meaning of
the word “surcharge” and it will be described to mean “an additional charge or
payment” or something similar. How much of an additional charge we do not
know. Neither do we know what kind of properties will be taxed. Single-family
homes? Condominiums? Hotels?
In fact, state legislators admit they don’t know either.
“Nothing has been determined on what type of property would be assessed and
what type of legislation we would be comfortable with,” said state House
Finance Committee Chair Sylvia Luke. (Honolulu Star-Advertiser, Sept. 18,
2018.) “So even if the property tax amendment passes, I doubt that the amount
generated would be in the range . . . the teachers' union suggests.”
“The reason I voted [for Senate Bill 2922] with reservations is because I did not
like the language,” said House Rep. Jimmy Tokioka (The Garden Island
newspaper, Sept. 19, 2018.) “I though it needed to be clearer about what the
amendment was actually going to do.”
If the legislators who helped to place this constitutional amendment on the
ballot aren't exactly sure what will do, how can they expect anyone to vote on
it? This begs the legal question as to whether it belongs on the ballot in the frst
place.
Because of this the County of Maui has joined the other counties of Hawaii in
an appeal from the First Circuit Court’s ruling in a lawsuit over Senate Bill No.
2922.
While the county certainly understands and appreciates the importance of
funding education, the ballot initiative as it is currently worded is not clear as
to whether the “surcharge” is a really a property tax, not clear as to what is
meant by “investment property,” and provides no guarantee of an increase in
funding for public education.
7. Corporation counsel for all counties argue collectively that the constitutional
amendments proposed by the state are of a magnitude which should require a
constitutional convention, like the convention in 1978 which gave complete
responsibility for the real property tax to the counties 40 years ago.
In this manner, all counties would be given the opportunity to send delegates to
a convention to discuss the proposed amendments, and contribute their 40
years of experience with the real property tax administration to the discussion
of such an important change to the Hawaii State Constitution.
The counties have also jointly fled an appeal to the Intermediate Court of
Appeals and a Writ — basically an emergency petition to the Supreme Court —
to bring up that this ballot measure is unclear and misleading.
Note that your property taxes help to pay for our police, fre, lifeguards, road
repair, water, wastewater, landfll operations as well as many other programs
and services. If the state needs the county's help to assist our teachers and their
students, there are better ways to do it.
