Do You Have an Identity
Theft Protection Plan for
Your Employees?
IMPORTANT INFORMATION EVERY EMPLOYER SHOULD KNOW
There’s a New Pennsylvania Supreme Court Ruling in
Regards to Identity Theft. This ruling was made in
November so you may not have heard about it yet.
Remember when UPMC suffered a security breach that resulted in over 60,000
employees having their personal information stolen?
It’s made it through the court system to the PA Supreme Court; and the court has
ruled that companies are responsible for the consequences of a security breach.
I obtained a copy of the PSC judgement and what popped out while reading it was
employees can sue their employers if they are breached.
The following slide is a brief summary:
New Court Ruling: Employers Must Protect Employees’
Identities, Personal Data
The landmark decision of Dittman v. UPMC
There were many notable elements of PSC’s ruling, but the most significant is the logic the court used
to reach their decision and the far-reaching implications this will likely have.
The Pennsylvania Supreme Court found that UPMC’s practice of collecting and storing sensitive
employee data constituted affirmative conduct. As such, the company had a responsibility to protect
all sensitive data and provide adequate security measures. Because UPMC failed to do this, the court
concluded that the data breach was “within the scope of the risk [UPMC] created.”
The PSC further protected employees’ right to sue negligent employers. According to the court,
employees can take legal action against a company even if their employer didn’t explicitly promise to
protect the data it collects. A contract is not needed, as this responsibility is the employer’s “common
law duty.”
Identity Theft Is Increasing
 Despite expensive security programs companies pay for identity
theft continues to increase.
 The Identity Theft Resource Center (ITRC) recently announced its
2017 Data Breach report and it's no surprise that breaches are up.
 In 2017 there were 1,579 data breaches exposing nearly 179 million
records. Check out 2018 in the next slide…
 That represents a 44% increase in the number of breaches and a
389% increase in records exposed.

1. Aadhar - 1.1 billion
2. Marriott Star-Westin – 500 million
3. Exactis – 340 million
4. MyFitnessPal – 150 million
5. Quora – 100 million
6. MyHeritage – 92 million
7. Cambridge Analytica - 87 million
8. Google – 52 million
9. Chegg – 40 million
10. Facebook – 29 million
What do all of these companies have in common? Based on news reports: Active and
impending class action law suits. Employees are suing employers too.
Reported Thefts
 Credit Card Fraud: 13,3015 reports
 Employment or tax-related fraud: 82,051 reports
 Phone or utilities fraud: 55,045 reports
 Bank fraud: 50,517 reports
 Loan or lease fraud: 30,034 reports
 Government documents or benefits fraud: 25,849 reports
 18th year in a row Identity Theft is the #1 reported complaint to FTC

Fraud Statistics
 Consumers reported $905 million in total fraud losses in 2017, a 21.6% increase
over 2016. The with a median amount lost was $429.
 Consumers reported $905 million in total fraud losses in 2017. Still waiting on
2018.
 21% of the consumers who reported a fraud-related complaint lost money. The
most common method money was paid out was via wire transfer.
 64% of all fraud-related complaints reported the method of initial contact.
 Of those complaints, 69.8% said the telephone and 9.7% said e-mail.
 Only 5% of those consumers reported mail as the initial point of contact.
Emotional Impact of Victims
 When it comes to the emotional impact of identity theft, many feel annoyance about the fact that they
have to spend so many hours dealing with the problem, often taking time away from work. These
statistics about the emotional impact of identity theft:
 66% of respondents experienced fear regarding their personal financial security.
 53% felt a sense of powerlessness or helplessness.
 7% reported feeling suicidal. (If you're feeling suicidal for this or any other reason, please call the
National Suicide Prevention Lifeline at 1-800-273-8255.)
 75% of identity theft victims reported that they were severely distressed by the misuse of their
information.
 25% of respondents said they sought professional help to manage their identity theft experience—
either going to a doctor for their physical symptoms, or seeking some kind of counseling (therapy,
group therapy, or some kind of support in that manner for the emotional implications).
The Financial and Emotional Impacts of
Identity Theft
The ITRC's latest Aftermath study showed 27% of identity theft complainants reported
they contacted law enforcement about the theft. Of those, 87% indicated a report was
taken.
However, identity theft has consequences beyond the loss of data and personal
information—it can take a lot of time and money to resolve and can bring emotional
distress. The statistics from the study show:
 26% of respondents had to borrow money from family or friends.
 22% took time off work.
 15.3% of respondents sold possessions to pay for expenses caused by their identity
theft.
 6.7% obtained a payday loan.
So how can businesses protect their companies and
employees?
The easiest and fastest was is subscribing to an identity

  • 1. Do You Have an Identity Theft Protection Plan for Your Employees? IMPORTANT INFORMATION EVERY EMPLOYER SHOULD KNOW
  • 2. There’s a New Pennsylvania Supreme Court Ruling in Regards to Identity Theft. This ruling was made in November so you may not have heard about it yet. Remember when UPMC suffered a security breach that resulted in over 60,000 employees having their personal information stolen? It’s made it through the court system to the PA Supreme Court; and the court has ruled that companies are responsible for the consequences of a security breach. I obtained a copy of the PSC judgement and what popped out while reading it was employees can sue their employers if they are breached. The following slide is a brief summary:
  • 3. New Court Ruling: Employers Must Protect Employees’ Identities, Personal Data The landmark decision of Dittman v. UPMC There were many notable elements of PSC’s ruling, but the most significant is the logic the court used to reach their decision and the far-reaching implications this will likely have. The Pennsylvania Supreme Court found that UPMC’s practice of collecting and storing sensitive employee data constituted affirmative conduct. As such, the company had a responsibility to protect all sensitive data and provide adequate security measures. Because UPMC failed to do this, the court concluded that the data breach was “within the scope of the risk [UPMC] created.” The PSC further protected employees’ right to sue negligent employers. According to the court, employees can take legal action against a company even if their employer didn’t explicitly promise to protect the data it collects. A contract is not needed, as this responsibility is the employer’s “common law duty.”

Identity Theft Is Increasing  Despite expensive security programs companies pay for identity theft continues to increase.  The Identity Theft Resource Center (ITRC) recently announced its 2017 Data Breach report and it's no surprise that breaches are up.  In 2017 there were 1,579 data breaches exposing nearly 179 million records. Check out 2018 in the next slide…  That represents a 44% increase in the number of breaches and a 389% increase in records exposed.
  • 5. The Top 10 Scariest Data Breaches this Past Year 1. Aadhar - 1.1 billion 2. Marriott Star-Westin – 500 million 3. Exactis – 340 million 4. MyFitnessPal – 150 million 5. Quora – 100 million 6. MyHeritage – 92 million 7. Cambridge Analytica - 87 million 8. Google – 52 million 9. Chegg – 40 million 10. Facebook – 29 million What do all of these companies have in common? Based on news reports: Active and impending class action law suits. Employees are suing employers too.

Reported Thefts  Credit Card Fraud: 13,3015 reports  Employment or tax-related fraud: 82,051 reports  Phone or utilities fraud: 55,045 reports  Bank fraud: 50,517 reports  Loan or lease fraud: 30,034 reports  Government documents or benefits fraud: 25,849 reports  18th year in a row Identity Theft is the #1 reported complaint to FTC Source: The Federal Trade Commission’s 2017 Consumer Sentinel Network Report
  • 7. Fraud Statistics  Consumers reported $905 million in total fraud losses in 2017, a 21.6% increase over 2016. The with a median amount lost was $429.  Consumers reported $905 million in total fraud losses in 2017. Still waiting on 2018.  21% of the consumers who reported a fraud-related complaint lost money. The most common method money was paid out was via wire transfer.  64% of all fraud-related complaints reported the method of initial contact.  Of those complaints, 69.8% said the telephone and 9.7% said e-mail.  Only 5% of those consumers reported mail as the initial point of contact.

Emotional Impact of Victims  When it comes to the emotional impact of identity theft, many feel annoyance about the fact that they have to spend so many hours dealing with the problem, often taking time away from work. These statistics about the emotional impact of identity theft:  66% of respondents experienced fear regarding their personal financial security.  53% felt a sense of powerlessness or helplessness.  7% reported feeling suicidal. (If you're feeling suicidal for this or any other reason, please call the National Suicide Prevention Lifeline at 1-800-273-8255.)  75% of identity theft victims reported that they were severely distressed by the misuse of their information.  25% of respondents said they sought professional help to manage their identity theft experience— either going to a doctor for their physical symptoms, or seeking some kind of counseling (therapy, group therapy, or some kind of support in that manner for the emotional implications).
  • 9. The Financial and Emotional Impacts of Identity Theft The ITRC's latest Aftermath study showed 27% of identity theft complainants reported they contacted law enforcement about the theft. Of those, 87% indicated a report was taken. However, identity theft has consequences beyond the loss of data and personal information—it can take a lot of time and money to resolve and can bring emotional distress. The statistics from the study show:  26% of respondents had to borrow money from family or friends.  22% took time off work.  15.3% of respondents sold possessions to pay for expenses caused by their identity theft.  6.7% obtained a payday loan.
  • 10. So how can businesses protect their companies and employees? The easiest and fastest was is subscribing to an identity theft protection plan to help avoid financial loss and emotional distress.
