The Comptroller of the Currency issued a consent order fining Wachovia Bank $10 million for unsafe and unsound banking practices related to its relationships with payment processors for telemarketers from 2003-2006. The bank failed to conduct proper due diligence on these high-risk customers, whose deposited remotely created checks were frequently returned by consumers who did not authorize the transactions. This caused financial harm to consumers and resulted in improper financial gain to the bank. Wachovia neither admitted nor denied the findings but consented to the penalty to resolve the matter.
