The City Council of Alamo Heights held their regular meeting on February 14, 2022. They approved the minutes from the previous meeting, received announcements about upcoming tree trimming, and heard comments from citizens. The Council ordered the general election to be held on May 7, 2022. They held a public hearing and approved rezoning a property from multi-family to parking. The police chief briefed the Council on the 2021 racial profiling report. The Council then met in executive session to discuss Broadway infrastructure construction before adjourning.

1. Mr. Mike Martin:
I am writing to request your immediate and effective action on several issues.
Bank of America and Chase continue to have business licenses despite being in violation
of Burien Municipal Code (BMC) 5.05.130 (2) and (5) prior to receiving their current
business license. This part of the BMC was put in to stop businesses who had prior
consent decrees for fraudulent actions from receiving a business license for a minimum
of two years after the decree so that it could be determined if they were fit to operate a
business in Burien.
Both of these banks have demonstrated they are unfit for licenses under BMC 5.05.130
(2) , (5) by causing tens of millions of dollars in loss of property value over the last
eighteen months, since the first annexation of North Highline. A couple of examples
from my neighborhood that are depressing house prices for a one mile radius are:
The City of Burien spent property tax money because Chase Bank refused to cleanup
garbage that was being dumped at one of their foreclosed properties located at 11416 26th
Ave. South. Chase ignored Burien’s phone calls for seven months before it signed a
sweetheart deal with the City of Burien’s attorney. I see no evidence that a lien was ever
filed to recover this money. Additionally, records on file at King County show Chase
receiving money in the amount of $367,163.84 from Fannie Mae for losses it alleges it
was owed while Chase was in custody of this house for Fannie Mae. Chase’s refusal to
maintain the property caused a dramatic drop in neighborhood house prices.
Subsequently this $400,000 house sold for $89,000. It would appear they defrauded
Fannie Mae by willfully refusing to maintain this house. Fortunately, this house was not
bought by a slumlord. It is now being rehabilitated.
I would have thought that after the Chase house, Burien would have been prepared for the
house down the street,, located at 11037 26th Ave S owned by Bank of America. I doubt
Burien even knows of its existence, or that Bank of America hasn’t bothered to maintain
it to the detriment of the neighborhood and Fannie Mae. Additionally, Bank of America
had the electricity cut to save money. After years of sitting empty and unheated, it is
likely to have a mold and mildew problem that will dramatically reduce its value and that
of the neighborhood. Additionally, it will be a potential source of respiratory infections.
The picture of the door shows that Bank of America is “visiting” this house yet they are
not maintaining it.
Up one block, at 11045 Roseberg Ave S, is another Bank of America house that is not
being maintained. Through the initial legal proceedings, the house was maintained. Yet
the day the actual foreclosure sign was put in the window, all maintenance ceased. Bank
of America is “visiting” this overgrown abandoned house (see the door picture for this
house). It is blighting the neighborhood and they are defaulting on their obligation to
Fannie Mae.
2. The City of Burien, by its lack of code enforcement is pushing homeowners underwater.
How many people have lost their homes through devaluation caused by Bank of America
and Chase so that these banks could defraud Fannie Mae while Burien sat idly by? Why
did your city attorney choose to not enforce the BMC with Chase by not withholding
their business license while the matter festered with this house?
Homeowners in Burien are trying to upgrade their properties yet despite our best efforts
our city government is stabbing us in the back so city politicians can appease the banks.
The City of Burien chose to allow tens of millions of dollars in property valuation losses
in my neighborhood so that Chase and Bank of America could save $750 per year in lawn
mowing expenses that are required by code.
The BMC provides a contract between homeowners and the City on what is reasonably
expected of all parties and penalties for failure to comply.
I am demanding the following:
1. Bank of America and Chase have their business license revoked immediately under
BMC 5.05.130 (2) , (5). for no less than 2 years due to prior consent decrees and
current violations of the BMC 5.05 140 (2).
2. Burien immediately levies fines of $125.00 per day against any bank owned house
that is not in compliance with all BMC requirements using BMC 5.05 (140 (2). Liens
are too be filed and foreclosed upon as soon as allowed by law. If any of these houses
are in bankruptcy, Burien should point out the obligation of both Banks and
mortgagee is too be in compliance with all BMC regulations to have any standing
before the Court.
You will either be the first City Manager in the United States to stand up and terminate
business licenses of banks that are engaged in illegal actions and lead the City of Burien
forward, or you will be fired for refusing to do so.

There are many foreclosed houses in Burien, Washington that are being allowed to
become fire hazards by the banks. The City of Burien is choosing to ignore these
foreclosed properties and putting neighboring residents and firefighters at risk.
If you view my slide share site you will see pictures of these houses and the dry brush
that is being allowed to consume them. I believe that the banks (Bank of America owns
two of these foreclosed houses in my neighborhood) should be cited and the King County
Prosecuting Attorneys office should be notified so that if there are injuries or fatalities
then the appropriate charges can be filed against the City of Burien’s City Manager, City
Council and the CEO of the banks.
I would appreciate you reviewing the City of Burien’s list of foreclosed houses, assuming
they have such, to see why this is being allowed to happen and direct them to take
immediate and lasting action to remedy this problem.

I have attached copies of letters to the Washington State Fire Marshall and Washington
State Patrol on unsafe conditions being allowed to exist in Burien, Washington.
The Washington State Patrol is being asked to review why unsafe conditions are being
allowed to exist for both pedestrians and drivers alike in Burien.
The Washington State Fire Marshall’s office is being asked to cite the Banks that have
abandoned their obligation to maintain the foreclosed houses in Burien.
In the event of injury or death in the above mentioned letters I believe it would be
prudent to review extenuating circumstances that may include charges against the City
Manager of Burien and its City Council for willful non-enforcement of Burien‘s
Municipal Code, and Bank CEO’s who are involved in an unlawful for profit enterprise
whose sole purpose is to defraud the United States Government out of Fannie Mae
insurance.
Mike Martin, City Manager of Burien, was quoted eloquently in the West Seattle Herald
on the matter of code enforcement and “Burien’s Policy” in the July 13, 2012 West
Seattle Herald. I believe safety is the first and foremost obligation of Burien. Its refusal
to enforce the Burien Municipal Code is putting people at risk.
Whatever assistance your office can provide in clarifying the obligations of both Burien’s
city government and Bank of America, etc. would be helpful in avoiding tragedy.

5. All members of the Washington State Legislature were
mailed hard copies of this letter on October 12, 2012
I believe the $5,000,000 per year the State of Washington has promised Burien,
Washington if it succeeds in annexing North Highline would be a waste of State money.
The annexation in April of 2011 by Burien of my neighborhood has resulted in a dramatic
drop in home values in the annexed area due to negligence and gross incompetence on
the part of the City of Burien.
Non-enforcement of Burien Municipal Code (BMC) is the primary problem. Mike
Martin (Burien City Manager) was quoted in the July 13th 2012, West Seattle Herald
about Burien’s policy of “reactively” dealing with code enforcement. The results of this
policy can be seen throughout Burien. I would invite you to tour Burien. Specifically,
look at the 2% of the homes that are non-compliant with the BMC and Burien’s lack of
effort to clean these homes up. Some of non compliant issues are:
Ÿ Foreclosed homes that are not being maintained by the banks.
Ÿ Rental homes with countless parked cars on the lawn. Many of these vehicles are not
licensed or are inoperable.
Ÿ Homes with trash spread about the yard.
Ÿ Sidewalks that are overgrown with blackberries and other invasive vegetation.
Ÿ Hedges that block visibility at intersections.
Every day Burien employees and administrators drive by these homes, yet they do
nothing. Mr. Martin may want you to believe that Burien has had a positive impact on
the neighborhoods that it serves. Google can take you on a curbside tour to witness what
things Burien may not want you to see. Take a Google tour of my neighborhood and see
the “good” things Burien has brought us.
Less than one month after Burien took control of my neighborhood, an empty foreclosed
house owned by Chase, at 11416 26th Ave. S., started having garbage dumped there.
Chase ignored Burien’s phone calls for seven months before it signed a sweetheart deal
with the City of Burien’s attorney so that the City could clean up the garbage at the City‘s
expense. At what cost?

will dramatically reduce its value and that of the neighborhood.

Ÿ Neighborhoods were built a few houses at a time. Not a lot of subdivisions here.

Ÿ And sadly cheap home prices.
Burien has chosen to spend its time on the downtown business section while ignoring the
efforts of 98% of its homeowners who are trying to upgrade their homes. The 2% (banks,
slumlords, and those that don’t care), are driving the value of our housing inventory into
the ground. The effects are not only visible in the neighborhood, but also can be seen in
the high vacancy rate in the downtown corridor. Without a vibrant housing market, the
retailers are one by one going out of business for lack of customers.
Banks such as Bank of America and Chase look for lazy city governments like Burien
that are willing to turn a blind eye on code enforcement. The City of Burien chose to
allow tens of millions of dollars in property valuation losses in my neighborhood’s one
mile radius so that Chase and Bank of America could save $750 per year per property in
lawn mowing expenses required by code.
Significant safety issues can be seen on my slide share site that shows Burien’s lack of
code enforcement is making it dangerous for both pedestrians and drivers alike.
In fairness to Mike Martin and the banks, the State of Washington should invite them to
Olympia to testify before the Legislature on the above mentioned matters plus other
BMC infractions that are found on your tour of Burien that are not being addressed.
What is the cost in lost revenue to Burien caused by the 2% in my neighborhood and how

my Slide Share site?
In conclusion, Burien is a city that takes money for services that it won’t perform.
Without a fundamental change in Burien’s approach to code enforcement, the upcoming
annexation will result in more financial losses for homeowners and the State of
Washington.
P.S. Many of these houses have or are in Bankruptcy proceedings. I would invite you to
examine the various legal documents to see if either the Banks or Burien has notified the
courts that these houses are non compliant with the BMC.

Dangerous conditions for pedestrians and cars are being allowed to exist in Burien,
Washington. These conditions are in direct violation of the Burien Municipal Code
Section 12.38.040 (2).
These violations fall into three categories:
Ÿ Vegetation (blackberry bushes, ivy, and hedges) that encroaches onto the sidewalks
such that pedestrians have to enter the roadway to get around the blockage.
Ÿ Hedges that block drivers visibility at stop signs.
Ÿ Vegetation that encroaches onto the roadway.
If you examine the pictures at my slide share site you will note that Burien has chosen to
prune some of these infractions. Unfortunately, this does not provide an acceptable
resolution to this issue. The only resolution is that the owner of the property be required
to remedy the infraction by either removing or maintaining the vegetation such that
sidewalks are usable at all times and intersections and roadways are free from
obstructions as specified in BMC 12.38.40 (2).
I would appreciate a Washington State Trooper visiting Mike Martin (City Manager) and
the City Council to work out a prompt and continuous resolution to these safety hazards
that exist throughout Burien.
Additionally, whatever statistics the Washington State Patrol has on crime rates and run
down neighborhoods would be beneficial for Burien to see so that public safety in general
would improve in Burien.

9. All United States Senators on the Senate Committee on
Banking, Housing, & Urban Affairs were mailed hard
copies of this letter on October 12, 2012.
Fraudulent activities on the part of the banking industry are occurring in Burien,
Washington a suburb of Seattle. Bank of America and Chase are the two banks in my
neighborhood who are defrauding Fannie Mae and the United States government through
willful non maintenance of foreclosed properties.
These two banks have stripped tens of millions of dollars in property values in my
community alone so that they can save $750 a year in lawn mowing expenses on each
house. With a reduction in personal net worth, the average person has less money to
spend, and thus the economy continues to struggle.
These banks require the acquiescence of local municipal governments to perpetrate these
activities. Burien, like most communities have municipal codes to effectively deal with
these non compliant issues yet they do nothing. The bankruptcy courts also do nothing
and the value of the estate plummets along with the neighborhood that surrounds these
cancerous properties that blight our landscape from coast to coast.

I would propose that Congress subpoena all documents (pictures, emails, letters, phone
logs, and legal filings / motions) and individuals from the City of Burien, the banks and
the Courts who oversaw these houses. Furthermore, there should be an inspection of all
Fannie Mae properties for proper maintenance. This will allow the housing market to
know exactly how many houses are waiting to enter the market. This will stabilize prices
by weeding out the non-maintained houses that are depressing house prices.
Additionally, by eliminating this fraudulent activity, Fannie Mae will have more money
to underwrite the housing recovery.
Most peoples biggest asset is their home. Until the assault on its value ceases, peoples’
hard work to improve their lives, their neighborhood and the economy will be in vain.
